Effective DateThese Terms become effective when first published on bearingfruitbc.com.These Terms and Conditions (“Terms”) govern access to bearingfruitbc.com and the coaching, consulting, educational resources, workshops, events, recordings, and other services provided by Bearing Fruit Business Collective, LLC (“BFBC,” “we,” “us,” or “our”).By accessing the website, purchasing a service, checking an acceptance box, registering for a cohort, or participating in a BFBC service, you agree to these Terms and the policies incorporated into them. If you do not agree, do not purchase or participate.
1. Eligibility and AuthorityYou must be at least 18 years old and legally capable of entering a binding agreement. If you register on behalf of an organization, you represent that you have authority to bind that organization.
2. ServicesBFBC provides coaching, consulting, educational programs, group discussions, frameworks, tools, resources, replays, and related services. Specific dates, deliverables, access periods, cohort sizes, and features may vary by offer and will be described on the applicable sales or registration page.We may make reasonable changes to content, sequencing, facilitators, technology, or delivery methods when needed to improve or safely deliver a service. Material schedule changes are handled under the Refund and Cancellation Policy.
3. Coaching and Educational DisclaimerBFBC services are educational and developmental. They are not psychotherapy, mental-health treatment, medical care, legal advice, tax advice, investment advice, financial planning, employment advice, or pastoral counseling. Participation does not create a doctor-patient, therapist-patient, attorney-client, fiduciary, clergy-penitent, or similar professional relationship.
You remain responsible for your decisions, actions, business activities, finances, health, safety, and results. Seek qualified professional advice when your circumstances require it.
4. No Guarantee of ResultsBFBC provides frameworks, coaching, perspective, and accountability, but does not guarantee any particular personal, professional, business, financial, spiritual, or other outcome. Results depend on many factors outside BFBC’s control, including your participation, effort, decisions, circumstances, and implementation.
5. Registration, Pricing, and Payment* Prices are stated in U.S. dollars unless otherwise indicated.
* Payment is due according to the checkout or registration page.
* You authorize BFBC and its payment processor to charge the selected payment method for the disclosed amount.
* You are responsible for accurate billing and contact information and for any taxes lawfully imposed on the purchase.
* Access may be delayed, suspended, or canceled if a payment is declined, reversed, fraudulent, or subject to an unresolved chargeback.
6. Group Participation and Community StandardsParticipants are expected to contribute to a respectful, constructive, and safe coaching environment. You agree not to:* Harass, threaten, demean, discriminate against, exploit, or intentionally embarrass another person.
* Disrupt sessions, impersonate another person, misrepresent qualifications, or use the program for unauthorized solicitation.
* Share unlawful, infringing, defamatory, fraudulent, or malicious content.
* Attend while engaging in conduct that materially interferes with the safety, privacy, or participation of others.BFBC may set reasonable participation rules and may mute, remove, suspend, or terminate a participant who materially violates these Terms.
7. Group ConfidentialityGroup coaching depends on trust. By participating, you agree that the identities, disclosures, stories, questions, goals, business information, documents, strategies, and personal circumstances shared by other participants will remain within the coaching cohort.You may not repeat, publish, post, forward, summarize, screenshot, photograph, record, download, or disclose another participant’s information outside the group without that participant’s express permission. You may not use cohort information to solicit, compete with, exploit, harass, embarrass, or harm another participant.Do not share supposedly anonymous information if the person or circumstances could reasonably be identified. Notify BFBC promptly if you become aware of unauthorized disclosure or recording.BFBC will take reasonable steps to communicate and enforce these expectations, but cannot guarantee the conduct of every participant. Group disclosures are not legally privileged. You are responsible for deciding what information you are comfortable sharing.Confidentiality does not prohibit disclosure that is authorized by the person who shared the information, required by law or legal process, reasonably necessary to prevent serious harm, or reasonably necessary for BFBC to investigate misconduct, enforce these Terms, or deliver the service.
8. Recordings and ReplaysSome live sessions may be recorded for replay access. BFBC will provide notice and obtain affirmative consent through registration and/or before recording begins. By affirmatively consenting and joining the recorded session, you authorize BFBC to capture and make your image, voice, display name, chat contributions, and participation available to authorized members of that cohort.If you do not consent to recording, contact BFBC before participating in a recorded live session. Participants may not independently record a session or share replay links or files.
BFBC will not use your image, voice, story, testimonial, or coaching exchange in public advertising without separate permission.
9. Intellectual Property and Limited LicenseBFBC and its licensors own the website, program names, frameworks, worksheets, videos, recordings, replays, graphics, exercises, written materials, and other original content, except for content clearly identified as belonging to someone else.Upon full payment, BFBC grants you a limited, revocable, non-exclusive, non-transferable license to use program materials for your own personal or internal business development. You may not reproduce, publish, sell, sublicense, teach, distribute, publicly display, create competing materials from, remove ownership notices from, or provide access to BFBC materials without written permission.A refund, charge reversal, policy violation, or termination of access ends this license. You must stop accessing the materials and delete copies when reasonably requested.
10. Participant ContentYou retain ownership of original content you submit. You grant BFBC a limited license to host, display, reproduce, or process that content only as reasonably needed to deliver the service, provide feedback, maintain records, protect safety, or comply with law.You represent that you have the right to share any content you submit and that doing so does not violate another person’s confidentiality, privacy, contract, or intellectual-property rights.BFBC will not use private participant content or coaching disclosures for public marketing without separate permission.
11. PrivacyOur collection and use of personal information are described in the BFBC Privacy Policy. By using the website or services, you acknowledge that policy.
12. Scheduling, Attendance, and TechnologyYou are responsible for using accurate contact information, reviewing session notices, joining on time, and maintaining the equipment and internet access needed to participate.If you miss a session, any available replay may be provided according to the applicable offer. A missed session does not change the refund-request deadline. BFBC is not responsible for disruptions caused by your device, internet service, software, environment, or failure to review notices.
13. Refunds, Cancellations, Transfers, and ReschedulingPurchases are governed by the BFBC Refund and Cancellation Policy. The current policy provides a full satisfaction refund when a valid request is received no later than 14 calendar days after the final scheduled live session, subject to the stated conditions and misconduct exceptions.If BFBC cancels a cohort or makes a material schedule change, participants will receive the options described in that policy.
14. Third-Party ServicesBFBC may rely on third-party services for payments, scheduling, forms, video conferencing, email, analytics, hosting, or file delivery. Those providers operate under their own terms and privacy policies. BFBC is not responsible for third-party outages, security practices, or content beyond the extent required by applicable law.
15. Suspension and TerminationBFBC may suspend or terminate access for nonpayment, fraud, unlawful conduct, harassment, threats, material disruption, confidentiality violations, unauthorized recording or distribution, intellectual-property infringement, or other material breach.When access ends, provisions concerning confidentiality, recordings, intellectual property, disclaimers, liability, dispute resolution, and any payment obligations that accrued before termination will survive.
16. DisclaimersTo the fullest extent permitted by law, the website, services, materials, recordings, and replays are provided “as is” and “as available.” BFBC disclaims warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted access, or error-free operation. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
17. Limitation of LiabilityTo the fullest extent permitted by law, BFBC and its owners, employees, facilitators, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, data, opportunities, or goodwill; or decisions made or actions taken based on the services.To the fullest extent permitted by law, BFBC’s total liability arising from a particular service will not exceed the amount you actually paid BFBC for that service. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
18. Informal Resolution and Governing LawBefore filing a legal claim, you and BFBC agree to make a good-faith effort to resolve the dispute informally by providing written notice and allowing 30 days for discussion, unless immediate relief is reasonably necessary.These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any court proceeding will be brought in a court with lawful jurisdiction in New Jersey, except where applicable consumer law gives you the right to proceed elsewhere.
19. Changes to These TermsWe may update these Terms as our services or legal obligations change. Revised Terms will be posted on our website with an updated effective date. Changes will apply prospectively unless applicable law requires otherwise.
20. Severability, Waiver, and Entire AgreementIf a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the Refund and Cancellation Policy, and offer-specific written terms form the agreement governing the website and services.
